{"id":561,"date":"2016-05-10T10:32:16","date_gmt":"2016-05-10T08:32:16","guid":{"rendered":"http:\/\/firearms-united.com\/?p=561"},"modified":"2016-06-05T13:53:21","modified_gmt":"2016-06-05T11:53:21","slug":"eugunban-finally-victory-libe","status":"publish","type":"post","link":"https:\/\/www.firearms-united.com\/es\/eugunban-finally-victory-libe\/","title":{"rendered":"#EUgunban: finally a victory at LIBE"},"content":{"rendered":"<p class=\"teaser\"><a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/\" target=\"_blank\"><em>Article by\u00a0Pierangelo Tendas (All4Shooters.com)<\/em><\/a><\/p>\n<h2 class=\"teaser\">Good news come from the EU as the vote at the LIBE Committee of the European Parliament turns out positively for law-abiding gun owners<\/h2>\n<div style=\"width: 258px\" class=\"wp-caption alignright\"><a id=\"li531dd161-2f58-42bf-99d5-8c5c7838cfd1\" href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-02.jpeg?resize=1170x540%3E\" rel=\"galleryimage\"><img decoding=\"async\" loading=\"lazy\" class=\"MEDIA\" title=\"EU gun ban: what's new?\" src=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-02.jpeg?resize=248x\" alt=\"Good news from the European Parliament as the planned EU gun ban is discussed at the Civil Liberties, Justice and Home Affairs committee (LIBE)\" width=\"248\" height=\"184\" \/><\/a><p class=\"wp-caption-text\">The LIBE Committee of the European Parliament voted on the amendments on May 9th, and the outcome was largely in our favour<\/p><\/div>\n<p class=\"align-justify\">In the late evening of May 9th, 2016, the\u00a0<a href=\"http:\/\/www.europarl.europa.eu\/committees\/en\/libe\/home.html\" target=\"_blank\">Civil Liberties, Justice and Home Affairs committee (LIBE)<\/a> of the European Parliament held an <a href=\"http:\/\/www.emeeting.europarl.europa.eu\/committees\/agenda\/201605\/LIBE\/LIBE(2016)0509_1\/sitt-2773094\" target=\"_blank\">electronic vote<\/a>\u00a0session on the <a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/LIBE-Amendments.pdf\" target=\"_blank\">amendments<\/a> to the committee&#8217;s <a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/LIBE-Draft-opinion.pdf\" target=\"_blank\">draft opinion<\/a> concerning the <a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/Commission-Draft.pdf\" target=\"_blank\">restrictive modification draft to the European firearms directive<\/a> as proposed by the European Commission. Said vote was initially planned for Tuesday, April 28th, but was postponed under request from the EPP, ECR and ALDE groups.<\/p>\n<p class=\"align-justify\">And indeed those three groups led\u00a0<i><b>common sense and sanity to victory<\/b><\/i> in today&#8217;s vote, throwing out of the window most, if not all, of the largely anti-gun proposals of the European Commission and of the social-democrat, left and green groups.<\/p>\n<p class=\"align-justify\">This article is also available in the following languages:\u00a0\u00a0<a href=\"https:\/\/www.all4shooters.com\/it\/Tiro\/legge\/Restrizioni-armi-UE-LIBE-GENVAL-COREPER\/\" target=\"_blank\">IT<\/a>\u00a0and <a href=\"https:\/\/www.all4shooters.com\/de\/Shooting\/Waffenkultur\/EU-Waffenverbot-LIBE-Erfolg-Parlament\/\">DE<\/a><\/p>\n<p class=\"align-justify\"><!--more--><\/p>\n<p class=\"align-justify\">While the LIBE&#8217;s role in the procedure is merely consultive in nature, the outcome of the vote is enough for all law-abiding gun owners to cheer:<\/p>\n<div class=\"clear\"><\/div>\n<div class=\"text textblock\">\n<ul>\n<li>The proposal to <i><b>ban \u00abCategory B7\u00bb modern sporting firearms <\/b><\/i>(a.k.a. \u00abmilitary-style\u00bb guns) was <i><b>rejected<\/b><\/i>.<\/li>\n<li>The proposal to severely restrict or even <i><b>impose licensing and registrations <\/b><\/i>for<i><b>deactivated and replica firearms <\/b><\/i>was <i><b>rejected<\/b><\/i>.<\/li>\n<li>Collectors are kept <i><b>out of the scope of the directive<\/b><\/i>.<\/li>\n<li>The proposal to <b><i>restrict detachable magazines <\/i><\/b>in capacity, to include them into the list of \u00abessential firearm components\u00bb and impose mandatory registration EU-wide was <b><i>rejected<\/i><\/b>; same goes for <i><b>silencers and sound suppressors<\/b><\/i>.<\/li>\n<li>The socialists&#8217; proposal to impose an <b><i>an additional tax on firearms and ammunitions <\/i><\/b>has been <i><b>rejected<\/b><\/i>.<\/li>\n<li>While <b><i>essential gun parts should be marked<\/i><\/b>, the proposal to impose <b><i>marking of ammunition <\/i><\/b>was <i><b>rejected<\/b><\/i>.<\/li>\n<li>Member States will still be allowed to <b><i>sell ex-military surplus to civilians<\/i><\/b> and to grant, although under certain conditions, <i><b>l<\/b><\/i><b><i>icenses for \u00abCategory A\u00bb military firearms and light weapons<\/i><\/b>.<\/li>\n<li>The proposal to impose <i><b>EU-common mandatory medical standards and tests <\/b><\/i>for the release and the renewal of gun licenses, and the proposal to impose an <b><i>EU-level standard expiry date for all gun licenses<\/i><\/b>, were both <i><b>rejected<\/b><\/i>.<\/li>\n<li>People under the age of 18 will still be <i><b>allowed to own and operate firearms <\/b><\/i>for hunting and sport shooting, albeit <i><b>under the supervision of an adult guardian <\/b><\/i>that should also be a licensed gun owner.<\/li>\n<li>While LIBE asks that the European Directive should refer to \u00abmandatory safe storage\u00bb for privately-owned firearms, conditions and standards for said \u00absafe storage\u00bb should be <b><i>left to each individual Member State <\/i>to establish on its own soil.<\/b><\/li>\n<li>EU Member States should established a <i><b>common database<\/b><\/i> of licensed gun owners. As \u00abBig Brother-ish\u00bb as it may sound, this could open the way for a future gun license reciprocity in the EU.<\/li>\n<\/ul>\n<\/div>\n<div class=\"clear\"><\/div>\n<div id=\"ir_c6a87075-ae20-4e2e-82d1-a4fe219d0d75\" class=\"floatLeft imageRepeater images COLUMN\">\n<div class=\"INSTANCE ODD FIRST LAST COUNT1\">\n<div class=\"lightboxThumbnail MEDIA\">\n<div style=\"width: 258px\" class=\"wp-caption alignright\"><a id=\"li21ffb742-0fc3-4b54-95b2-b6de58280e10\" href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-03.jpg?resize=1170x540%3E\" rel=\"galleryimage\"><img decoding=\"async\" loading=\"lazy\" class=\"MEDIA\" title=\"EU gun ban: what's new?\" src=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-03.jpg?resize=248x\" alt=\"Good news from the European Parliament as the planned EU gun ban is discussed at the Civil Liberties, Justice and Home Affairs committee (LIBE)\" width=\"248\" height=\"165\" \/><\/a><p class=\"wp-caption-text\">The Members of the European Parliament are obviously aware that restrictions on law-abiding gun owners would not stop terrorists, criminals, and madmen!<\/p><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"text textblock\">\n<p class=\"align-justify\">While the <i><b>main battle is fought at the\u00a0<a href=\"http:\/\/www.europarl.europa.eu\/committees\/en\/imco\/home.html\" target=\"_blank\">Internal Market and Consumer Protection committee (IMCO)<\/a><\/b><\/i>, which is tasked with providing the European Parliament as a whole of a draft to vote on, the one at LIBE is definitely an<i><b>important victory<\/b><\/i>: the LIBE committee was supposed to be the <i><b>most overtly hostile environment<\/b><\/i> for gun owners, and it&#8217;s unlikely that the situation at IMCO could be any worse than this.<\/p>\n<p class=\"align-justify\">Sure, the victory at LIBE is <i><b>no cause to let our guard down<\/b><\/i>: our community can expect that in the next days and weeks, the European Commission and the Council of European Union \u2212 both currently<i><b>supportive of the ban<\/b><\/i> \u2212 may stage some kind of <i><b>reaction<\/b><\/i>. Things haven&#8217;t been going as the anti-gunners expected, right from the very get go, and that&#8217;s why we should all brace for some kind of <i><b>dirty trick<\/b><\/i>.<\/p>\n<\/div>\n<div class=\"clear\"><\/div>\n<div id=\"ir_eed786a2-5667-48b0-802d-ff2e637b8ccf\" class=\"floatRight imageRepeater images COLUMN\">\n<div class=\"INSTANCE ODD FIRST LAST COUNT1\">\n<div class=\"lightboxThumbnail MEDIA\">\n<div style=\"width: 258px\" class=\"wp-caption alignright\"><a id=\"lif8758274-3d81-40e0-b219-48ecda11f9e6\" href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-04.jpg?resize=1170x540%3E\" rel=\"galleryimage\"><img decoding=\"async\" loading=\"lazy\" class=\"MEDIA\" title=\"EU gun ban: what's new?\" src=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-04.jpg?resize=248x\" alt=\"Good news from the European Parliament as the planned EU gun ban is discussed at the Civil Liberties, Justice and Home Affairs committee (LIBE)\" width=\"248\" height=\"175\" \/><\/a><p class=\"wp-caption-text\">Unfortunately the European Commission and the Dutch Presidency \u2212 both fancifully supportive to the ban proposal \u2212 may be willing to try and play some dirty trick<\/p><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"text textblock\">\n<p class=\"align-justify\">And as a matter of fact, if the IMCO draft should be in our favour and the European Parliament should vote against the proposed EU gun ban, the European Commission and Council could<b><i>reject the Parliament ruling<\/i><\/b>, thus forcing the matter towards the very lengthy procedures of a <a href=\"http:\/\/europa.eu\/eu-law\/decision-making\/procedures\/index_en.htm\" target=\"_blank\">conciliation committee<\/a>. Both the Council and the Parliament could veto and block the legislative proposal at this final reading \u2212 and that <b><i>frightens the anti-gun EU institutions<\/i><\/b>, as the time is running out for the current Dutch Presidency of the EU (which is <b><i>overtly supportive of the ban proposal<\/i><\/b>) and the next two Presidencies \u2212 Slovakia, from July 2016 to January 2017, and then Malta, from January to June 2017 \u2212 are both <i><b>supportive of the rights of law-abiding gun owners<\/b><\/i>.<\/p>\n<p class=\"align-justify\">That&#8217;s why a <a href=\"http:\/\/firearms-united.com\/2016\/05\/07\/how-the-council-works\/\" target=\"_blank\">recent note<\/a> by the growing association known as <a href=\"http:\/\/firearms-united.com\/\" target=\"_blank\">FIREARMS UNITED<\/a> is once again <b><i>calling European gun owners to action <\/i><\/b>against the next moves of the European Commission and the Dutch Presidency.<\/p>\n<\/div>\n<div class=\"clear\"><\/div>\n<div id=\"ir_93391916-ea81-4b34-836b-63621bbb9cea\" class=\"floatLeft imageRepeater images COLUMN\">\n<div class=\"INSTANCE ODD FIRST LAST COUNT1\">\n<div class=\"lightboxThumbnail MEDIA\">\n<div style=\"width: 258px\" class=\"wp-caption alignright\"><a id=\"li6ac4e857-4e51-4503-a366-41ed1d846c30\" href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-05.jpg?resize=1170x540%3E\" rel=\"galleryimage\"><img decoding=\"async\" loading=\"lazy\" class=\"MEDIA\" title=\"EU gun ban: what's new?\" src=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/EU-gun-ban-LIBE-05.jpg?resize=248x\" alt=\"Good news from the European Parliament as the planned EU gun ban is discussed at the Civil Liberties, Justice and Home Affairs committee (LIBE)\" width=\"248\" height=\"320\" \/><\/a><p class=\"wp-caption-text\">FIREARMS UNITED calls all its followers and supporters to remain vigilant and keep the pressure high on the European institutions<\/p><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"text textblock\">\n<p class=\"align-justify\"><a href=\"http:\/\/firearms-united.com\/\" target=\"_blank\">FIREARMS UNITED<\/a> obtained and released a <a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/st08516.en16.pdf\" target=\"_blank\">classified working document<\/a>of the <a href=\"http:\/\/www.consilium.europa.eu\/en\/meetings\/mpo\/2015\/9\/wp-on-general-matters-including-evaluation-(241169)\/\" target=\"_blank\">Working Party on General matters, including Evaluation (GENVAL)<\/a>, which would seem to hint that <i><b>the European Commission, the Council and the Dutch Presidency haven&#8217;t lost their will to disarm law-abiding European citizens<\/b><\/i>, and that the Dutch Presidency may be thinking of appointing the<a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-gun-ban-LIBE-GENVAL-COREPER\/Call-To-Action-EN.pdf\" target=\"_blank\"> Committee of Permanent Representatives (COREPER) to propose the gun ban draft<\/a> to the plenary session of the Council of the European Union instead of GENVAL, so to <i><b>prevent any \u00abinterference\u00bb from law-abiding citizens against liberticide restrictions<\/b><\/i> and to avoid discussing the<i><b>solid objections opposed by many technical and legal experts<\/b><\/i>.<\/p>\n<p class=\"align-justify\">Facing this new anti-democratic attempt to forcefully pass a package of restrictions whose only motivation is to <i><b>save the helplessly incompetent European Commission&#8217;s face in front of its citizens<\/b><\/i>, we at <i><a href=\"http:\/\/www.all4shooters.com\/en\" target=\"_blank\">all4shooters.com<\/a><\/i> join FIREARMS UNITED&#8217;s call to action: all law-abiding gun owners should <a href=\"https:\/\/www.all4shooters.com\/en\/Shooting\/law\/EU-Gun-Ban-European-Commission-Council-GENVAL-Firearms-United\/Call-To-Action-EN.pdf\" target=\"_blank\">keep up the pressure on the European institutions<\/a>.<\/p>\n<\/div>\n<div class=\"text textblock\">\n<h2><a href=\"http:\/\/firearms-united.com\/2016\/05\/07\/how-the-council-works\/\">Click here to read and download the new call to action from FIREARMS UNITED<\/a><\/h2>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Article by\u00a0Pierangelo Tendas (All4Shooters.com) Good news come from the EU as the vote at the LIBE Committee of the European Parliament turns out positively for law-abiding gun owners In the late evening of May 9th, 2016, the\u00a0Civil Liberties, Justice and Home Affairs committee (LIBE) of the European Parliament held an electronic vote\u00a0session on the amendments to the committee&#8217;s draft opinion &#8230;
